We recognize the Act’s aspiration to broaden digital access for Filipinos. At the same time, we believe it is important to address areas that may affect cybersecurity, national safeguards, and the overall stability of the telecommunications sector—an industry critical to both the economy and national security.
CYBERSECURITY AND NATIONAL SECURITY
Telecommunications networks form part of the country’s security backbone. Provisions on operator vetting and the two-year grace period for cybersecurity certification may inadvertently leave gaps in protection. Alignment with existing laws—such as the Cybercrime Prevention Act, the Data Privacy Act, the Anti-Terrorism Act, and the Anti-OSAEC/CSAEM Law—can help ensure stronger safeguards for citizens and the state.
SPECTRUM MANAGEMENT AND INTERNATIONAL OBLIGATIONS
We also highlight the importance of managing spectrum use responsibly. Unregulated use by satellite operators may lead to harmful interference with defense and disaster-response frequencies, and could put the Philippines at risk of breaching international treaty commitments.
REGULATORY INTEGRITY AND MARKET STABILITY
For decades, the Congressional franchise requirement has provided oversight and stability in the industry. Its removal may create uncertainty for investors and expose established operators—who have complied with rigorous standards—to uneven competition. Preserving a level playing field is essential to maintain investor confidence and continued infrastructure growth.
